Terms of Service

1. Service provider

The services described on this website and in associated applications are provided by DUNA AI LIMITED (“DUNA AI”, “DunaAI”, “we”, “us”), a company established in Ireland. References to the “Service” in these Terms include our public website, software applications (including any iOS or Android applications), APIs and any related services we provide.

2. Acceptance of these Terms

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Service. If you accept these Terms on behalf of a legal entity, you represent that you have authority to bind that entity.

3. Eligibility

You must be at least 16 years old, or the minimum age required to consent to the processing of personal data in your country, to use the Service. Where the Service is offered to professional or business users, additional eligibility criteria may apply.

4. Accounts and access

Some features may require an account. You are responsible for providing accurate registration information, for keeping your credentials secure, and for all activity that takes place under your account. You must notify us promptly of any unauthorised use of your account at support@dunaai.dev.

5. Acceptable use

You agree to use the Service in compliance with applicable law and these Terms. In particular, you must not:

• use the Service to engage in unlawful, fraudulent, harmful, deceptive or infringing activity;
• upload, submit or transmit content that is illegal, defamatory, harassing, infringes intellectual property rights or violates privacy rights;
• attempt to gain unauthorised access to the Service, other accounts, or our systems and networks;
• disrupt or interfere with the operation, security or integrity of the Service, including by deploying malware or denial-of-service techniques;
• scrape, harvest or otherwise extract data from the Service in ways not expressly authorised;
• reverse engineer, decompile or disassemble the Service, except to the extent permitted by applicable law;
• use the Service to generate content that exploits, sexualises or endangers minors, promotes hatred or violence against protected groups, or undermines democratic processes;
• use the Service to make decisions about individuals that produce legal or similarly significant effects without appropriate human oversight.

6. AI features and output disclaimer

The Service may include AI-enabled features that generate, analyse, classify or transform content based on inputs you provide. AI outputs are generated automatically and may be inaccurate, incomplete, biased or otherwise unsuitable for a particular purpose. AI outputs are provided “as is” and should not be relied upon without independent review and human judgement.

You are responsible for evaluating the suitability of any AI output for your context, and for any decisions or actions you take based on AI output. The Service is not designed to provide, and must not be used as a substitute for, legal, medical, financial, tax, safety or other professional advice. Where you input content into AI features, you confirm that you have the necessary rights to do so and that the content does not violate applicable law or third-party rights.

7. No professional advice

Information made available through the Service, including AI outputs, documentation and marketing content, is provided for general informational purposes only. It does not constitute professional advice and should not be relied upon as such. You should consult an appropriately qualified professional for advice specific to your situation.

8. Intellectual property

The Service, including its software, design, branding, documentation and content (excluding user content), is owned by or licensed to DUNA AI LIMITED and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose. No other rights are granted.

9. User content

You retain ownership of content you submit to the Service (“User Content”). By submitting User Content, you grant us a worldwide, royalty-free licence to host, store, process, transmit and display that content solely as necessary to provide, maintain, secure and improve the Service for you, including where relevant by processing it through AI-enabled features and trusted subprocessors.

You are solely responsible for User Content. You represent that you have the rights and permissions necessary to submit it to the Service. We may remove or restrict access to User Content that we believe in good faith violates these Terms or applicable law.

10. Subscriptions, payments and trials

Where the Service includes paid plans, subscriptions, in-app purchases or trials, the specific commercial terms (price, billing cycle, trial duration, cancellation, renewal, refunds and applicable taxes) will be disclosed at the point of purchase or in the relevant product documentation. By subscribing, you authorise the applicable recurring charges through the payment method or app store you selected.

Subscriptions purchased through the Apple App Store or Google Play are managed by the relevant store. You may need to cancel such subscriptions through your Apple or Google account settings before the next renewal date. Deletion of your DunaAI account does not by itself cancel an active App Store or Google Play subscription.

If paid plans are not currently offered for a particular product, this section applies prospectively and will become operative when such plans are introduced.

11. Service availability and changes

We aim to keep the Service available and reliable but do not guarantee uninterrupted availability. The Service may be modified, suspended or discontinued in whole or in part, including for maintenance, security, legal or business reasons. Where we make significant changes to features, we will use reasonable efforts to inform users.

12. Third-party services

The Service may integrate with or link to services operated by third parties (for example payment providers, AI model providers, cloud infrastructure, scheduling tools, and developer or app store platforms). Your use of those third-party services is governed by their own terms and privacy policies, and we are not responsible for their content, security or practices.

13. Termination

You may stop using the Service at any time. You may request deletion of personal data we hold about you via our Data deletion page; when DunaAI introduces user accounts or applications, account-deletion will be covered there too. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these Terms, if your use creates legal, security or operational risk, or if required by law. On termination, the rights granted to you under these Terms end immediately; provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability and governing law) will continue to apply.

14. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, quality or uninterrupted operation. This section does not exclude any warranties that cannot be excluded under applicable law.

15. Limitation of liability

To the maximum extent permitted by applicable law, DUNA AI LIMITED and its directors, employees, agents and suppliers will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for loss of profits, revenue, data, goodwill or business opportunities, arising out of or in connection with the Service, even if advised of the possibility of such damages.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be excluded under Irish law.

16. Indemnification

You agree to indemnify and hold harmless DUNA AI LIMITED from and against claims, damages, liabilities, losses and reasonable expenses arising out of your breach of these Terms, your User Content, or your unlawful use of the Service, except to the extent caused by our own gross negligence or wilful misconduct.

17. Changes to these Terms

We may update these Terms from time to time. Where changes are material, we will use reasonable efforts to provide notice, for example by posting a notice in the Service or sending an email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. Governing law and jurisdiction

These Terms are governed by the laws of Ireland, without regard to its conflict of laws rules. Subject to mandatory consumer protection rules that may apply in your country of residence, the courts of Ireland will have exclusive jurisdiction over disputes arising from or related to these Terms or the Service.
